NOTES ON THE FLYNN SENTENCING

FACTS:


1 - Flynn plead guilty of lying to the FBI.


2 - Shady Judge Contreras is ousted, in comes Judge Sullivan.


3 - Prosecution asks for successive delays in the sentencing.


4 - Details emerge about apparent irregularities committed by FBI and SC investigative teams against Flynn. (We later learn that not all these depositions were made to the SC Office).


5 - In their sentencing memo, the prosecution asks for little or no jail time for Gen. Flynn, because of his meaningful and prompt collaboration in several investigations.


6 - In their sentencing memo, the defense asks for no jail time, short probation and 200 hours of community work.


7 - The defense memo comments on the irregularities on the investigation.


8 - The defense memo hints at Brady violations in discovery.


9 - Judge Sullivan orders all materials filed - both unredacted under seal, and redacted on the public docket.


10 - Come sentencing time, Judge asks Flynn if he won't withdraw his guilty plea. He declines.


11 - This makes no sense, since the charges are bogus. Judge doesn't have all the facts, apparently - as we also don't. Things don't reconcile, as Q would say.


12 - Judge gets really crossed, and is tempted to assume that Flynn won't withdraw his guilty plea because he IS guilty in the Turkish FARA case that he testified about.


13 - Judge makes regrettable remarks about Flynn's work as a lobbyist. I won't repeat them.


14 - After recess, Judge backtracks his earlier remarks, and the defense takes up the offer to delay the sentencing. Next status meeting set for another 90 days.


THINGS THAT DON'T "MAKE SENSE":


15 - If FBI said Gen. Flynn didn't lie, why later prosecute him for exactly that?


17 - If this frame-up was so obvious, why did the General plead guilty?


18 - If the case was so hollow, as Judge Sullivan clearly saw, HOW COME Flynn did not withdraw his guilty plea?


19 - After all, even though the Prosecution asked for "little or no jail time", it is up for Sullivan to decide. So there is indeed risk of prison.


20 - WHY ON EARTH WOULD FLYNN DO THAT?


We know.
